Official Contest Rules & Regulations
THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW
- CONTEST PERIOD:
Enter to win a $150 Visa Gift Card (“CONTEST”) begins on January 1, 2023 at 9:00 a.m. Pacific Daylight Time Zone (PDT) and ends on December 31, 2023 at 9:00 a.m. PDT (the “Contest Period”).
- ELIGIBILITY:
Contest is open to all legal residents of Canada who have reached the legal age of majority in Canada at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Lift Auto Group (the “Sponsor”), its parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”).
- HOW TO ENTER:
NO PURCHASE NECESSARY.
Any person who receives and completes a customer satisfaction survey from a Lift owned and operated Collision Repair Centre is automatically entered into the draw for a chance to win.
- THE PRIZES AND APPROXIMATE RETAIL VALUE:
There will be four (4) Grand Prizes available to be won consisting of a $150 Visa Gift Cards. These will be drawn and awarded as four (4) separate prizes. The Grand Prizes have an approximate retail value of $150.00 (CAD). Grand Prizes are not transferable.
The prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prizes with a prize of equal or greater value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. All gift cards are subject to the terms and conditions placed on them by their issuer.
Without limiting the generality of the foregoing, the following general conditions apply to the Prizes: (i) Prizes must be accepted as awarded and are not transferable or convertible to cash (no substitutions except at Sponsor’s option); (ii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prizes or any component thereof; and (b) substitute the Prizes or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (iii) by accepting the Prizes, the winners agree to waive all recourse against the Releasees (defined below) if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (iv) neither Sponsor nor any of its prize suppliers will replace lost or stolen Prizes.
- RANDOM PRIZE DRAW AND WINNER SELECTION:
On April 1 2023, July 1 2023, October 1 2023, and January 3, 2024 (the “Draw Dates”) in Kelowna, BC at approximately 10:00 a.m. Pacific Daylight Time Zone, one (1) eligible entrant will be selected by random draw from among all eligible Entries received during the Contest Periods. The odds of winning depend on the number of eligible entries received during the Contest Periods in accordance with these Rules.
The Sponsor or its designated representative will make three (3) attempts to contact the selected entrants by telephone or email (using the information provided at the time of entry) within three (3) business days of the Draw Date. If the selected entrant cannot be contacted within three (3) attempts or three (3) business days of the Draw Date (whichever occurs first), or there is a return of any notification as undeliverable; then the selected entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the forgoing provisions of this section shall apply to such new selected entrant).
The Prizes will be delivered to the addresses the confirmed winners provided when entering the Contest.
- GENERAL CONDITIONS:
All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or entrants.
The Releasees will not be liable for any failure of the website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Entry to be received by the Contest Parties for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected Entry.
The Sponsor reserves the right, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind, or for any other reason.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
- INTELLECTUAL PROPERTY
All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.
- RULES PREVAIL
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest entry form/paper ballot, and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.
